Commercial Linkage Fee Public Hearing - Continued Discussion

Staff Report [PDF] - On October 14th, the Planning Commission held the third public hearing regarding a commercial linkage fee study and reviewed a draft linkage fee ordinance. Housing staff and the consulting firm Keyser Marston Associates (KMA) presented additional information on the impact of a commercial linkage fee. The Planning Commission requested that staff incorporate their comments into the draft ordinance and return for review. Staff has revised the draft Commercial Linkage Ordinance, Attachment 2, and the draft Commercial Linkage Fee Resolution, Attachment 3. In addition, Attachment 4 is the Negative Declaration and Attachment 1 is the proposed resolution of the Planning Commission recommending to City Council the adoption of the Commercial Linkage Fee Ordinance and Fee Resolution.

Commercial Linkage Fee Public Hearing - Continued Discussion

Staff Report [PDF] - Housing Element Program 13.19 is to study a potential commercial linkage fee for affordable housing. On May 13th, a jobs-housing nexus study for a linkage fee was presented to the Planning Commission. On July 15, 2004, Housing staff and the consulting firm Keyser Marston Associates (KMA) presented additional information on the impact of a commercial linkage fee. The Planning Commission requested that staff draft a linkage fee ordinance for further consideration, and provide alternative parameters for comparison. In addition to the draft ordinance, the Commission requested further information, as follows: 1) an analysis of how revenue from a linkage fee might leverage additional resources for affordable housing, and how many new affordable units could be produced; 2) the impact of the fee on the developer’s return and residual land value; 3) clarification of the current office and retail vacancy rates in Walnut Creek; and 4) the sizes of commercial projects developed in the city over the past six years.
